By accessing or using Prismagick™ ("the Platform"), operated by Grand Rising Consulting LLC ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.

2. Description of Service

Prismagick is an AI-powered marketing assistant platform designed for network marketers. The Platform provides AI coaching, content generation, contact management, outreach automation, voice interactions, and related tools.

3. Account Responsibilities

• You must provide accurate and complete registration information.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must be at least 18 years old to use the Platform.

4. Acceptable Use

You agree not to:

• Use the Platform for any unlawful purpose or in violation of any applicable laws.
• Send unsolicited messages (spam) via email or WhatsApp through the Platform.
• Upload or transmit harmful, offensive, or infringing content.
• Attempt to reverse-engineer, decompile, or extract source code from the Platform.
• Interfere with or disrupt the Platform's infrastructure or other users' experience.
• Misrepresent AI-generated content as professional financial, legal, or medical advice.

5. AI-Generated Content Disclaimer

The Platform uses artificial intelligence to generate content, suggestions, and coaching responses. AI-generated content is provided for informational and marketing purposes only and does not constitute financial, legal, medical, or professional advice. You are solely responsible for reviewing and verifying all AI-generated content before use.

6. Communication Compliance

When using the Platform to send emails or WhatsApp messages, you are responsible for:

• Obtaining proper consent from recipients before sending messages.
• Complying with all applicable anti-spam laws (CAN-SPAM, GDPR, TCPA, etc.).
• Honoring opt-out and do-not-contact requests promptly.
• Ensuring message content complies with WhatsApp Business Policy and email service provider terms.

7. Intellectual Property

• Your Content: You retain ownership of all content you create or upload to the Platform, including knowledge base entries, contacts, snippets, and links.
• Our Platform: The Platform, its design, branding, code, and AI models are the intellectual property of Grand Rising Consulting LLC.
• AI-Generated Content: Content generated by the AI using your knowledge base is considered your content. Generic AI outputs without personalization are not exclusively owned by any user.

8. Subscription & Payments

Access to certain features may require a paid subscription. Subscription terms, pricing, and billing cycles will be presented at the time of purchase. We reserve the right to modify pricing with reasonable notice.

9. Account Suspension & Termination

We may suspend or terminate your account if you violate these Terms, engage in abusive behavior, or if required by law. You may delete your account at any time by contacting us. Upon termination, your data will be deleted in accordance with our Privacy Policy.

10. Limitation of Liability

To the maximum extent permitted by law, Grand Rising Consulting LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total liability shall not exceed the amount you paid for the service in the twelve months preceding the claim.

11. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that AI-generated content will be accurate, complete, or suitable for any particular purpose.

12. Indemnification

You agree to indemnify and hold harmless Grand Rising Consulting LLC from any claims, damages, or expenses arising from your use of the Platform, your content, or your violation of these Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to conflict of law principles.

14. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Continued use of the Platform after changes constitutes acceptance of the revised Terms.
